Distance Sales Agreement
This Distance Sales Agreement ("Agreement") is prepared in accordance with Turkish Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation, and governs distance sales contracts formed electronically via defua.co between the Seller identified below and the Buyer placing an order.
Parties
Seller: Defua (defua.co) — Email: hello@defua.co. Buyer: the customer who provides their name, delivery address, and contact details when placing an order.
Subject of the Agreement
The subject of this Agreement is the determination of the rights and obligations of the parties, in accordance with Law No. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the product(s) ordered electronically by the Buyer through the Seller's defua.co website, as described on the site and confirmed at checkout.
Product and Order Information
The type, characteristics, quantity, sale price, payment method, and delivery details of the product(s) covered by this Agreement are those shown in the order summary the Buyer views and confirms at checkout and in the order confirmation email; this information forms an integral part of this Agreement.
General Provisions
The Buyer confirms having read and understood the pre-contractual information on the site regarding the product's essential characteristics, sale price, payment method, and delivery, and having given the required electronic confirmation. The Seller undertakes to deliver the product to the Buyer or the person at the address indicated, within the legally required period, taking into account the estimated delivery time stated on the site. For personalized products, the production time is stated separately on the product page.
Right of Withdrawal
The Buyer has the right to withdraw from the contract within 14 days of receiving the product, without giving any reason and without paying any penalty. To exercise this right, it is sufficient to notify the Seller within this period via hello@defua.co or the return process on the site. Upon exercising the right of withdrawal, the product price and any delivery cost will be refunded to the Buyer within 14 days of the Seller receiving the withdrawal notice.
Products Not Eligible for Withdrawal
Pursuant to Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised, once production has begun, for products made to the Buyer's specifications or personal requirements (such as personalized name necklaces/bracelets). Requests to change such products can be made by contacting the Seller before production begins.
Dispute Resolution
Disputes arising from this Agreement fall, within the monetary limits announced annually by the Ministry of Trade, under the jurisdiction of the Provincial/District Consumer Arbitration Committees at the Buyer's place of residence, and beyond those limits, the Consumer Courts.
Effect
The Buyer declares having read and accepted this Agreement electronically when placing an order on the site; the Agreement takes effect upon order confirmation.
